Compliance requirements
A bidder may be excluded if the bidder or a person with authority to represent, manage or control it has, within the last five years or while an exclusion period remains in force, been convicted of participating in a criminal organisation, corruption, fraud, a terrorist offence or related activity, money laundering or terrorist financing, or the use of child labour or another form of human trafficking. The bidder may also be excluded for unpaid taxes or social security contributions under the applicable rules; the notice states that a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. A mandatory ground applies where the bidder or relevant person has been penalised for allowing a foreign national without legal grounds to work or for breaches of the conditions for employing a foreign national, including paying less than the statutory wage. A bidder must also be excluded if awarding the contract to it would violate an international or Estonian government sanctions measure. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.
