Compliance requirements
A bidder will be excluded if the bidder or a person with management or representation authority has been convicted of participating in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, enabling illegal employment or breaches of rules on the employment of foreign nationals, or illegal use of child labour or human trafficking. Grounds for exclusion also include unpaid national taxes, duties or environmental charges, a breach of international or government sanctions, and a legal prohibition on submitting a tender.
The contracting authority may exclude a bidder for breaches of environmental, social or labour-law obligations; bankruptcy or liquidation; serious professional misconduct; unpaid local taxes; anti-competitive conduct; an unavoidable conflict of interest; obtaining an undue advantage in the procurement; material breach of a previous public contract; submission of false information; or misleading information intended to influence the contracting authority. The bidder must confirm that no exclusion grounds apply. If the bidder relies on another entity’s resources, it must also provide the required confirmation for that entity.
Qualification criteria and exclusion grounds
The bidder must meet the following requirements for Lots 1–4 (Põlva, the two Pärnu lots and Jõgeva):
- The bidder must not have materially breached administrative contracts or be in circumstances that could lead to permanent insolvency or cessation of business. In a joint tender, every member must meet these conditions. The bidder must provide confirmations. These conditions do not apply to public-law entities.
- Between 1 January 2023 and publication of the contract notice, the bidder must either have taught computer-use skills as part of formal education or have delivered at least 160 contact hours in total of computer-related group training. Computer-use guidance provided as part of a work-practice or work-club service commissioned by the Estonian Unemployment Insurance Fund does not count. The bidder must submit qualification information using the required form and state whether it relies on another entity’s resources.
- The tender must name the trainers and provide their details using the form specified in the procurement documents, and include the curriculum using the required form. The substantive requirements for trainers and the curriculum are set out in points 11 and 10, respectively, of Appendix 1 to the procurement documents.
- Training must be offered at the location specified in point 2 of Appendix 1 to the procurement documents, no more than a 10-minute walk from an official public transport stop. The tender must state the venue address.
- For a joint tender, the bidders must appoint an authorised representative and provide a power of attorney. The bidder must confirm that the tender complies with the procurement documents; if an equivalent solution is offered, its equivalence must be explained and supported by evidence. Other relevant evidence may be accepted if it demonstrates compliance with the requirements.
- The bidder must identify and justify any information in the tender claimed as a trade secret. The tender price, itemised prices and figures corresponding to award criteria may not be designated as trade secrets.
