Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The contracting authority must exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to enabling unlawful employment of foreign nationals or breaches of the conditions for their employment in Estonia, including underpayment; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, duty or environmental charge debt, or tax or social security contribution debt under the law of its country of establishment. The contracting authority may also exclude a bidder for a substantial or persistent breach of a previous public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty; or for providing false information about compliance with qualification requirements or failing to provide such information or requested supporting documents. A bidder established in Russia or Belarus is not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must have been worth EUR 40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period and the other contracting party’s details, including the client representative’s telephone number and email address, and procurement reference numbers where applicable. On request, evidence of proper performance must be provided unless the contracting authority can obtain it from public or private databases without significant effort. The bidder must have a person with valid switching authorisations for switching operations related to the works in 0.22–20 kV electricity networks, excluding regional and distribution substations. The person must be registered in Elektrilevi’s partner portal before tenders are opened. For works limited to low voltage (0.22–1 kV), at least low-voltage switching authorisation is required; otherwise, both low- and medium-voltage switching authorisations are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The applicable training procedure is set out in document J387. The bidder must have a person assigned responsibility for the work operation, with valid authorisation and registered in the partner portal before tenders are opened. The applicable requirements are set out in documents J31 and J3284. The bidder must also have a person leading electrical works with valid A-class competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. That person must hold the relevant evidence by the tender submission deadline and be registered in the partner portal before tenders are opened. The tender must include a price table in the prescribed format, with every unit-price field completed, and must follow the completion instructions for management-system document V178. By submitting a tender, the bidder accepts all tender-document conditions; conditional tenders and tenders with additional conditions are not permitted. The bidder must provide the name, position and contact details of each authorised contract signatory and of the contact person for contract matters. If the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The standard payment period from receipt of the invoice is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days. The bidder must identify and justify any information claimed as a trade secret; the tender price and evaluation-related figures may not be designated as trade secrets. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin. No award criterion is specified in the provided documents.
