Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must be excluded if it, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation; breach of duty of integrity or corruption; fraud; terrorist offences or related involvement; money laundering or terrorist financing; enabling the unlawful employment of a foreign national, including paying below the statutory wage; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding state taxes, duties or environmental charges, or tax or social-security contributions owed under the law of its country of establishment. The contracting authority may also exclude a bidder that has substantially or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty. It may exclude a bidder that has provided false information about meeting the qualification requirements or has failed to provide that information or requested supporting documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must have been worth EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant effort. The bidder must have the following personnel, entered in Elektrilevi’s Partner Portal (EPP) before tenders are opened: an employee authorised to perform switching operations in the 0.22–20 kV electricity network (excluding regional and distribution substations), and a person appointed as responsible for the work operation. For low-voltage works only (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person leading electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Qualifications Act, has the relevant evidence by the tender submission deadline, and is entered in EPP before tenders are opened. The tender must include a price table using the prescribed form, with every unit-price field completed, and must accept all tender-document conditions without additions or conditional terms. The bidder must provide the names, titles and contact details of the contract signatory or signatories and a contract-performance contact person; if the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bidder must state which information constitutes a trade secret and explain why; prices and other information used to evaluate tenders may not be designated as trade secrets. The bidder must not be established or resident in Russia or Belarus. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The stated standard payment periods, from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
