Compliance requirements
The bidder will be excluded if it, or a member of its administrative, management or supervisory body, an authorised representative, or another person empowered to represent, decide for or control it, has been convicted of participation in a criminal organisation; breach of integrity obligations or a corrupt act; fraud; a terrorist offence or another offence related to terrorist activities, including incitement, aiding or attempted commission; money laundering; or terrorist financing. The same applies to convictions for enabling a foreign national to work while unlawfully present in the country, enabling breaches of the conditions for a foreign national’s employment in Estonia (including payment below the statutory wage rate), unlawful use of child labour, or human trafficking. The bidder will also be excluded if it has outstanding state tax, payment or environmental charges within the meaning of the Taxation Act, or outstanding tax or social security contributions under the law of its country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damages or a contractual penalty. Exclusion may also apply if the bidder has provided false information about compliance with qualification requirements or failed to submit required information or additional documents.
Companies established or resident in the Russian Federation or the Republic of Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The bidder must have the following personnel, entered in Elektrilevi’s partner portal before tenders are opened: a worker holding valid switching rights for the relevant work on the 0.22–20 kV network (excluding regional and distribution substations), and a person designated as responsible for the work operation. For work involving only low-voltage installations (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The switching rights must be obtained in accordance with the specified training procedure. The bidder must also have a person leading electrical work who, at the time tenders are submitted, holds valid A-class competence and/or a qualification of at least level 6 under the Professions Act, with supporting evidence, and who is entered in the partner portal before tenders are opened.
The tender must comply with the procurement documents; conditional tenders and tenders containing additional conditions are not permitted. The price must be submitted using the prescribed table, with every unit-price field completed, taking account of the V178 control-system document instructions. The bidder must identify and substantiate any information claimed as a trade secret; prices and other specified evaluation-related figures or indicators may not be designated as trade secrets. The bidder must provide the name, position and contact details of the contract signatory or signatories and a contact person for contract-related matters. If signing authority does not arise from the articles of association, a power of attorney must be included.
The contracting authority’s standard payment period, calculated from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
