Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment of a foreign national or violations of rules governing a foreign national’s employment in Estonia, including payment below the statutory wage rate; or unlawful use of child labour or human trafficking. A bidder with outstanding state tax, payment or environmental charges, or tax or social security contribution debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder for a serious or persistent breach of an important term of a previous public contract that led to termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that provided false information about compliance with qualification requirements or failed to provide that information or requested supporting documents. Companies established in the Russian Federation or the Republic of Belarus are not permitted to participate. The bidder must confirm that it is not established in either country.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement; at least one contract must have a value of EUR 40,000 or more excluding VAT. The bidder must submit a list showing the performance period, details and contact information for the other contracting parties, and procurement reference numbers where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from a database without significant cost. The bidder must have a person appointed as responsible for the work operation, registered in the EPP environment before bids are opened. The person leading the electrical works must hold a valid A-level competency and/or a qualification of at least level 6 under the Professions Act, and must also be registered in the EPP environment before bids are opened. The bid must include the price proposal using Form 1, with every unit-price field completed. The bidder must provide the required information about any subcontractors it plans to use on Form 2. The bid must identify the person or persons authorised to sign the contract, state their names, job titles and contact details, and name a contact person for contract-related matters. A power of attorney must be included if the signatory’s authority does not arise from the articles of association. The bidder must identify any information in the bid claimed as a trade secret and explain why, or state that the bid contains no trade secrets. Prices and other indicators used to assess the bid may not be designated as trade secrets. The contracting authority’s standard payment term, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment term. The supplied documents do not specify the award criteria; check the tender documents for the applicable criteria.
