Compliance requirements
The bidder may be excluded if the bidder or a person in its management, administrative or supervisory bodies, or a person authorised to represent or control it, has a relevant conviction within the last five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Exclusion may also apply for tax or social security contribution arrears; the stated threshold is EUR 0. Under Estonian rules, a tax debt certificate is not issued where the debt is below EUR 100 (excluding interest not established by an administrative act) or payment has been rescheduled; foreign bidders are assessed under the law of their country of establishment. Mandatory national grounds include enabling a foreign national to work without legal grounds or in breach of employment conditions, including payment below the statutory rate, and entering into the contract in breach of an international or Estonian government sanction. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have performed, or be performing, at least two similar contracts during the 36 months preceding the procurement. The contracts must concern the direct production and sale of heat; at least one must have a value of EUR 30,000 per year. An ongoing contract may count if the required service volume is being provided. The bidder must describe the work in the ESPD and, if requested, provide a confirmation from the client that it was performed properly.
The bidder must have a quality management system meeting ISO 9001 or an equivalent standard and submit a certificate issued in the bidder’s name for a system applied in the construction works sector.
The bid must be unconditional and comply with the tender documents. Prices must follow the structure specified in the pricing sheet. The bidder must also submit an estimate of the expected investment cost, including the concept, technical solution and other relevant information sufficient to assess the scope and suitability of the works and, where needed, the estimated residual value of the investment. Where equivalence is claimed, the bidder must explain it and provide supporting evidence. The supplied documents do not specify award criteria.
