Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must not be subject to mandatory exclusion grounds arising from convictions of the bidder or relevant persons authorised to represent, manage or control it for participation in a criminal organisation, breach of duty or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment of a foreign national or breaches of rules on employing foreign nationals in Estonia, including underpayment; or illegal child labour or human trafficking. The bidder must also have no outstanding national tax, levy or environmental charge debt, or tax or social security contribution debt under the law of its country of establishment. The contracting authority may exclude a bidder for serious or persistent breaches of an earlier public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information about qualification or failing to submit required information or documents. An undertaking established in Russia or Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of €100,000 or more, excluding VAT. Submit a list showing each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address), and, for public contracts, the reference number. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense. The bidder must have: - A worker authorised to perform switching operations related to the works in the 0.22–20 kV electricity network, excluding regional and distribution substations, registered in Elektrilevi’s partner portal before tenders are opened. For works limited to 0.22–1 kV, low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The relevant training procedure is set out in document J387. - A person appointed as responsible for the work operation, registered in the partner portal before tenders are opened. The applicable procedures are set out in documents J31 and J3284. - A person directing electrical works who holds a valid A-class competence and/or at least level 6 qualification under the Professions Act, has the relevant evidence by the tender submission deadline, and is registered in the partner portal before tenders are opened. The tender must include a price table using the form in the procurement documents, with every unit-price field completed. The bidder must accept the procurement-document terms without additions or conditional terms. Provide the name, position and contact details of the contract signatory or signatories, together with the details of the contact person for contract matters. If signing authority does not arise from the articles of association, include a power of attorney. The contracting authority’s standard payment terms, counted from receipt of the invoice, are 14 calendar days for contracts up to €59,999; 35 calendar days for contracts from €60,000 to €249,999; and 45 calendar days for contracts of €250,000 or more. Participation in the authority’s factoring programme entails a 95-calendar-day payment term. Identify any information claimed as a trade secret and justify that designation; the price and evaluation-related figures may not be designated as trade secrets.
