Compliance requirements
A bidder may be excluded for relevant convictions of the company or its representatives within the previous five years, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also include breaches of tax or social security payment obligations; breaches of environmental, social or labour law; insolvency, liquidation, bankruptcy, creditor arrangements, similar proceedings, court or liquidator administration of assets, or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; significant or persistent failures under previous contracts resulting in early termination, damages, price reductions or penalties; and false or misleading information, failure to provide information or requested documents, or improper attempts to obtain confidential information or influence the procurement. National grounds include enabling an unlawfully present foreign national to work or breaching rules on foreign workers, being subject to international sanctions, convictions for tax offences, and—if provided for in the procurement documents—local tax arrears. Where applicable, the notice provides for the possibility of demonstrating remedial measures to restore reliability.
