Compliance requirements
The bidder must declare whether it or any person authorised to represent, manage or control it has, within the last five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Declarations also cover breaches of tax and social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot be prevented by other means; involvement in preparing this procurement that creates an unfair advantage which cannot otherwise be remedied; serious or repeated failures under previous public contracts; and false or misleading information, failure to provide requested information or documents, or improper attempts to obtain confidential information or influence the procurement decision.
The declarations also cover enabling a foreign national to work without a legal basis or in breach of applicable employment conditions, being subject to an international sanction, and convictions for tax offences. The tax and social security debt threshold is stated as EUR 0; however, under the explanatory note, an Estonian tax debt certificate is not issued where the relevant debt is below EUR 100 or its payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment. Where permitted, a bidder may provide evidence of measures taken to restore its reliability.
