Compliance requirements
The bidder must declare whether any exclusion grounds apply to it or its relevant representatives. These include final convictions within the applicable period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking; tax or social-security payment arrears; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, a comparable situation or suspended business activity; serious professional misconduct; agreements that distort competition; an unmanageable conflict of interest or improper involvement in preparing the procurement; significant or repeated breaches of earlier contracts resulting in termination or penalties; false or misleading statements, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procurement. Mandatory grounds also include enabling the unlawful employment of a foreign national and being subject to an international or Estonian government sanction. The bidder must also confirm that the offered goods are not sanctioned goods and are not from sanctioned regions, and that prohibited Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value. If a ground applies, evidence of measures taken to restore reliability may be submitted where the rules or tender documents allow it.
Qualification criteria and exclusion grounds
No specific financial-capacity, experience, staffing or professional-qualification thresholds are stated in the available documents. The bidder must submit an offer that complies with the tender documents; conditional offers are not permitted. Prices must follow the structure specified in the pricing section. Where an equivalent product or solution is offered, the bidder must explain the equivalence and provide supporting evidence. For furniture, all wood used must come from legal sources; evidence of origin, such as an FSC certificate or a FLEGT or CITES licence, must be provided when the furniture is delivered.
