Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions of the bidder or its representatives, including participation in a criminal organisation, breaches of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment or breaches of foreign workers’ employment conditions; illegal child labour or human trafficking; outstanding state taxes, duties or environmental charges, or tax and social-security arrears under the law of the bidder’s country; and being subject to an international sanction where contract award would breach that sanction.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation or comparable insolvency situations; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unavoidable conflict of interest; prior involvement in preparing the procurement that creates an unavoidable competitive advantage; substantial or repeated material breaches of earlier public contracts; false or missing information or documents concerning exclusion or qualification requirements; attempts to improperly influence the contracting authority, misleading information or attempts to obtain confidential information; relevant tax offences of the bidder or its legal representative; or lack of the legal right to submit a tender. The bidder must confirm that none of these grounds apply.
Entities established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods and components installed or used during the works may not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin as evidence.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must submit extracts from the annual accounts for those three years showing the net turnover, unless the information is publicly available to the contracting authority from a register. At least six months must have elapsed since the end of the latest completed financial year by the tender submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement. At least one of these contracts must have had a value of at least EUR 80,000 excluding VAT. The bidder must submit a list of the contracts, including their performance periods, the contracting parties’ information and the client representative’s contact details, as well as the procurement reference numbers for public contracts. Evidence of proper performance must be provided at the contracting authority’s request unless the information can be obtained from public or private databases without significant expense.
The bidder’s team must include a person leading the electrical works who has valid A-level competence and/or a qualification of at least level 6 under the Professional Qualifications Act, holds the relevant proof by the tender submission date and has been registered in Elektrilevi’s Partner Portal before the tender deadline. The team must also include a person with valid switching authorisations for work-related switching operations in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration, except in regional and distribution substations. For low-voltage-only works, at least low-voltage switching authorisations are required; in other cases both low- and medium-voltage switching authorisations are required where applicable. This person must be registered in the Partner Portal before tenders are opened. The bidder must additionally have a person responsible for the work operation, registered in the Partner Portal before the tender deadline.
The tender must include the required price table with all unit-price fields completed and must not contain additional conditions or conditional terms. The bidder must provide the names, positions and contact details of the contract signatory or signatories and a contract-performance contact person; a power of attorney must be added where signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must also identify and justify any trade secrets, or state that the tender contains none.
