Purchase of an N3-category maintenance vehicle with interchangeable superstructure

The bidder must confirm that neither the bidder nor its management or supervisory board members, procurists or authorised representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or trafficking in human beings. The bidder must also have no outstanding tax or social security debt, bankruptcy, liquidation, insolvency proceedings, suspended business activities, serious professional misconduct, anti-competitive agreements or unresolved conflict of interest. Exclusion may also apply because of a serious or repeated breach of a previous public contract, early termination, damages or penalties, false statements, failure to provide required information or documents, attempts to influence the contracting authority or obtain confidential information. Compliance with environmental, social and labour-law obligations is also checked, as are national grounds relating to employing unlawfully staying foreign nationals, international sanctions and convictions for tax offences. Where permitted by applicable law or the tender documents, the bidder may provide evidence of measures taken to restore its reliability. The bidder must provide the required declarations in the ESPD and, where necessary, supporting evidence.

The bidder must be registered in the business register of its country of establishment where registration is required by that country’s law. A foreign bidder must provide registration evidence on request if the information is not freely available to the contracting authority from a public database. To demonstrate technical and professional capacity, the bidder must have properly performed at least one contract during the 36 months preceding the start of the procurement. The contract must have involved the sale or supply of an N2- or N3-category heavy vehicle, a special-purpose motor vehicle or a road-maintenance vehicle. The bidder must provide a description of the contract subject, its value, completion date and the details of the other contracting party. The tender must comply with all tender documents and the technical specification. The bidder must submit a completed technical description with the offered vehicle and equipment’s numerical characteristics, and identify the manufacturer and model of the base vehicle, interchangeable summer and winter superstructures, and equipment. Any claimed equivalence must be explained and supported with evidence where necessary. Conditional tenders are not permitted, and the tender price must follow the required structure. The bidder must confirm compliance with the warranty conditions and undertake to deliver the vehicle together with all superstructures and equipment no later than 15 June 2027. The vehicle must have the valid type approval or other approval required for placing it on the EU market, registration and use, and must meet the requirements for registration and use in Estonia. During the warranty period, the bidder must provide competent maintenance and repair capacity in Tartu city or Tartu County, technical support 24 hours a day, 7 days a week, and mobile repair capability where necessary. The tender must describe these arrangements and name the service provider and service location. The bidder must confirm that it will not use, for more than 10% of the contract value, sanctioned Russian individuals or entities, entities controlled by them, or subcontractors or suppliers acting on their instructions. The offered goods must not be subject to international sanctions or originate from a sanctioned territory. A joint tender must include a power of attorney for the joint bidders. All information and declarations in the business register and ESPD, as well as all required confirmations and evidence, must be complete and accurate.
