Compliance requirements
The bidder may be excluded if it, or a person in its management, supervisory or representative body, has a relevant final conviction within the past five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, or if an exclusion period imposed by a conviction is still in force. The bidder may be asked to provide information about measures taken to restore its reliability where that remedy is available.
Exclusion grounds also include unpaid taxes or social security contributions, enabling a foreign national without legal grounds to work or allowing breaches of rules on a foreign national’s employment conditions, including payment below the statutory wage rate, and contracting with an entity subject to international or Estonian sanctions where this would breach the sanctions. The contracting authority may also provide for exclusion because of local tax arrears under the applicable rules. The bidder must confirm its position on the relevant grounds and, where required, provide supporting information. Tax and social security contribution debts below EUR 100 may not be certified as arrears under the stated Estonian rule, and exclusion does not apply where payment has been rescheduled.
Qualification criteria and exclusion grounds
The bidder must have properly completed, as the lead contractor during the 36 months preceding the publication date of the contract notice, at least one street design contract at least to the basic design stage. The reference project must include both stormwater drainage and street lighting design, and the design contract must have been worth at least EUR 55,000 excluding VAT. The bidder must provide the street designed, confirm that both systems were included, and state the contract period, value and client details, including the client representative’s telephone number and email address. For a public procurement reference, the procurement reference number must also be given.
The bid must accept all tender-document conditions, cover all matters for which the contracting authority requested competing bids, and be unconditional. The bid price must follow the structure specified in the tender documents. Where the bidder relies on another entity’s capacity, it must submit that entity’s consent using the required form and the entity’s procurement passport. Joint bidders must appoint an authorised representative and submit the required power of attorney. The bidder must identify and justify any information claimed as a trade secret; the bid price and other specified evaluation figures cannot be treated as trade secrets. Where equivalence is relevant, the bidder must explain it and provide supporting evidence.
