Compliance requirements
The bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to enabling unlawful employment of foreign nationals, including paying less than the statutory wage; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, contribution or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to provide requested information or supporting documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 100,000 in each of the last two completed financial years. The bidder must provide extracts from the annual reports for those years showing net turnover. An Estonia-registered legal entity need not provide documents or data that are publicly available to the contracting authority through a register. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to its last two completed financial years. At least six months must have elapsed since the end of the last completed financial year by the bid submission date.
With its bid, the bidder must submit the completed Form 1 for an order of the approved 15KKP266A arc suppression coil and sketches or drawings of the equipment. The form must be completed in full; partial completion may result in rejection of the bid. The bidder must also provide the name, title and contact details of the person or persons authorised to sign the contract, and the details of a contact person for contract-related matters. A power of attorney must be included if signing authority does not follow from the articles of association. The bidder must offer a warranty of at least 24 months from handover of the equipment to the contracting authority or its authorised contractor. The bidder must confirm that neither it nor the offered goods or their components originate from Russia or Belarus; the contracting authority may request certificates of origin. The bidder must identify and justify any trade secrets in the bid, but may not classify the bid price or specified evaluation-related figures as trade secrets.
