Compliance requirements
A bidder must be excluded if it, or a person authorised to represent, direct or control it, has been convicted of participation in a criminal organisation, bribery or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving the unlawful employment of foreign nationals, breaches of the conditions for employing foreign nationals in Estonia, unlawful child labour or human trafficking. A bidder must also be excluded if it has outstanding national tax, levy or environmental charges, or tax or social security contributions due under the law of its country of establishment.
The contracting authority may exclude a bidder for serious or persistent breaches of a previous public contract that led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. Businesses established in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction work similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have been worth EUR 40,000 or more, excluding VAT. The bidder must submit a list stating the performance period, details of the other contracting parties (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference numbers. The contracting authority may request evidence of proper performance unless it can obtain the information from public or private databases without significant expense.
Before bids are opened, the bidder must have the required personnel registered in Elektrilevi’s partner portal: a worker with valid switching rights for the relevant 0.22–20 kV network operations, and a person appointed to be responsible for the work operation. For low-voltage-only work (0.22–1 kV), low-voltage switching rights are sufficient; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The bidder must also have a person leading electrical work who holds valid A-level competence and/or a qualification of at least level 6, has the relevant proof by the bid submission deadline and is registered in the portal before bids are opened.
The bid must comply with all tender document requirements; conditional bids or bids with additional conditions are not permitted. The bidder must submit the price using the prescribed table and complete every unit-price field, taking account of the instructions for document V178. The bidder must provide the contract signatory’s name, title, contact details and proof of authority where that authority does not arise from the articles of association, as well as the contact person’s details for contract matters. The bidder must confirm that the installed materials, equipment, goods and components are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin.
