Compliance requirements
The bidder must declare whether it, or any person authorised to represent, manage or control it, has a relevant conviction within the past five years or remains subject to an exclusion period. The offences include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. The bidder must also declare whether it or such persons have been convicted of tax offences.
The bidder must declare whether it has unpaid taxes or social-security contributions. The notice sets the threshold at EUR 0; however, under the stated Estonian rules, a tax-debt certificate is not issued where the debt managed by the same tax authority is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment. The bidder may report that the obligations have since been met or that a binding payment arrangement has been made.
Other grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation or comparable proceedings; an agreement with creditors; assets being administered by a liquidator or court; suspended business activities; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement where an advantage cannot otherwise be removed; and serious or persistent breach of a previous contract resulting in early termination, damages or comparable sanctions. Grounds also cover false or misleading information, failure to provide required information or documents, improper attempts to influence the procedure or obtain confidential information, enabling unlawful employment of a foreign national, and circumstances in which awarding the contract would breach an international or Estonian government sanction. The contracting authority may restrict participation by place of establishment under the conditions in the procurement documents. For applicable grounds, the bidder may describe measures taken to restore its reliability where the law or procurement documents permit this.
