Compliance requirements
The bidder or persons with powers of representation, management or control may be excluded for relevant convictions, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, an arrangement with creditors or suspended business; serious professional misconduct; breaches of environmental, social or labour obligations; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where an resulting advantage cannot otherwise be prevented; and serious or repeated failures under previous contracts leading to early termination, damages, a price reduction, penalties or comparable sanctions.
Exclusion may also apply if the bidder provides false or misleading information, withholds required information, fails to provide requested supplementary documents, seeks confidential information improperly or attempts to influence the buyer’s decisions. National grounds include enabling the employment of a foreign national without a legal basis, breaching international sanctions and relevant tax offences. The bidder must declare whether any ground applies. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. For tax or social security debt, the stated threshold is EUR 0; the notice also explains that a tax-debt certificate is not issued for debt below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled.
