Compliance requirements
Exclusion grounds include final convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration of assets, or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be remedied; significant or repeated failure to perform a previous public contract resulting in early termination, damages, price reduction or a comparable sanction; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. National grounds include enabling an unlawfully present foreign national to work, being subject to international sanctions, and convictions for tax offences. The stated tax information notes that, under Estonian rules, a tax-debt certificate is not issued for a debt below EUR 100 or where payment has been deferred. Where an exclusion ground applies, the tenderer may provide evidence of measures taken to restore its reliability when this is permitted for the procurement.
