Compliance requirements

The bidder must confirm that neither it nor its management or supervisory body members, authorised representatives or procurists have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal employment of children or trafficking-related offences. The bidder must also not have outstanding tax or social security liabilities, be bankrupt, in liquidation or insolvency proceedings, have suspended business activities, have committed a serious breach of professional conduct, entered into agreements distorting competition, have a conflict of interest, been improperly involved in preparing the procurement, or seriously breached previous public contracts resulting in early termination, damages or another sanction. Grounds for exclusion may also arise from false statements, failure to provide material information or requested documents, or improper attempts to influence the contracting authority. Compliance with environmental, social and labour-law obligations, rules concerning the employment of unlawfully staying foreign nationals, international sanctions and any restrictions based on the bidder’s place of establishment or residence is also checked. The bidder must be able to provide proof, or verifiable electronic information, that taxes and social security contributions have been paid. Where an exclusion ground exists, remedial measures demonstrating regained reliability may in certain cases be submitted, subject to the applicable law and tender documents.

Qualification criteria and exclusion grounds

The bidder must have experience selling similar food products during the 36 calendar months preceding the tender submission deadline, covering at least one uninterrupted period of 12 months. The total value of the relevant sales contract must be at least EUR 50,000 excluding VAT. For at least one previous contract, the bidder must provide the buyer’s name and contact details, the sales period, the contract value and, where the contract resulted from a public procurement, the procurement reference number. The tender must confirm compliance with all tender document requirements and include the required forms, including the bidder declarations and information form, as well as the completed technical description and price schedule. The tender must be unconditional and its price must follow the contracting authority’s prescribed structure. In a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must identify any trade secrets and justify that designation; the tender price and product figures used for evaluating goods may not be designated as trade secrets. Where relevant, an explanation and evidence of equivalence must be provided. The offered goods must not be subject to international sanctions or originate from sanctioned regions. Neither the bidder nor its subcontractors may be established or resident in the Russian Federation or the Republic of Belarus.
