Compliance requirements

A bidder will be excluded if the company or one of its management or supervisory board members, procurists or representatives has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing. Exclusion also applies to convictions for enabling the employment of an unlawfully present foreign national, breaching the conditions for employing a foreign national in Estonia, including paying below the required wage, unlawful use of child labour, or human trafficking offences. The bidder must not have outstanding state tax, duty or environmental charge obligations, or tax and social security payment debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, or for submitting false information or failing to submit required information or documents. The bidder must confirm that none of these exclusion grounds applies. Participation is not permitted for companies established or resident in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and the reference numbers for public contracts. The contracting authority may also request evidence of proper performance. The bidder must have an employee with valid switching rights for the switching operations required in the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least MP switching rights are required; in other cases both MP and KP switching rights are required. The bidder must also have a person responsible for the work operation, known as the C-person, registered in the same portal before the tenders are opened. The bidder must have a person managing the electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Estonian Professional Qualifications Act, possesses the relevant certificate and is registered in Elektrilevi’s partner portal before the tenders are opened. The tender must comply with all procurement document requirements; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit the completed price table in the required format with all unit-price fields filled in, confirmation of the signatory’s authority to represent the bidder, the signatory’s and contact person’s details, and a power of attorney where necessary. The bidder must identify and justify any trade secret, or confirm that the tender contains no trade secrets. Materials, equipment and goods, including components, produced in or originating from the Russian Federation or Belarus may not be used during the works; the contracting authority may request certificates of origin as proof.
