Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, terrorism-related offences or corruption. The bidder must also have no unpaid taxes or social security contributions; the stated threshold is EUR 0, while tax debt below EUR 100 or debt under an approved payment arrangement is treated according to the applicable tax rules. The exclusion grounds also cover breaches of environmental, social and labour obligations, bankruptcy or insolvency proceedings, liquidation, agreements with creditors, similar insolvency situations, administration of assets by a liquidator or court, suspended business activity, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing the procurement, serious failures under previous public contracts, false or omitted information, failure to submit requested documents, improper attempts to influence the procedure, and applicable national exclusion grounds. The bidder must confirm compliance with international sanctions rules and the rules concerning unlawful employment of foreign nationals. Where an exclusion ground applies, evidence of remedial measures may be submitted where permitted by law or the tender documents.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three construction contracts in similar buildings during the 60 months preceding the start of the procurement. Each building must have a closed net floor area of at least 1,000 m². Similar works must have included a new central heat-recovery mechanical ventilation system, a new or reconstructed central building automation system, a new or reconstructed electrical system, and a new or reconstructed low-voltage system. The bid must include a list of the three contracts, their building-use codes, net floor areas, performance periods, a short description, contracting-party information and contact details; for public contracts, the reference numbers must also be provided. Evidence of proper completion must be submitted at the contracting authority’s request. The project manager must hold a qualification equivalent to a level 7 certified heating, ventilation and refrigeration engineer. The person responsible for electrical works must hold a Class B competence certificate or an equivalent foreign qualification. The person responsible for fire and security alarm systems must hold a level 5 security systems technician qualification covering the installation and maintenance of automatic fire alarm systems, or an equivalent qualification. Names and professional certificate numbers must be provided, and supporting qualification documents must be submitted upon request, including where the specialists are subcontractors. The bidder or relevant subcontractor must have a construction activity notice in the Estonian Register of Economic Activities or an equivalent registration or authorisation in its country of establishment. The bidder must visit the contract performance site and inspect the explanatory documents at the site before submitting a bid; the visit must be arranged two working days in advance. The bid must follow the required price structure, include the price schedule and a work schedule in the prescribed forms, and must not be conditional. The bidder must confirm compliance with the tender documents and provide an explanation and evidence of equivalence where applicable. The bidder must also comply with the restrictions on Russian-related subcontractors and suppliers, prohibited subcontractors subject to replacement, and sanctioned goods or goods originating from sanctioned territories. Joint bidders must submit an authorisation for their representative.
