Compliance requirements

A bidder will be excluded if the bidder or a person with management, supervisory or representation powers has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, enabling unlawful employment of foreign nationals, breaches of remuneration requirements, unlawful child labour or human trafficking offences. Exclusion also applies in the event of outstanding state tax, payment or environmental charge debts, or tax and social security payment debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous procurement contract where this resulted, for example, in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may likewise follow from submitting false information about compliance with the qualification requirements or failing to submit required information or documents. The bidder must confirm that none of the mandatory or discretionary exclusion grounds applies. Participation is not permitted for an undertaking whose place of residence or establishment is in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one such contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the client representative’s telephone and email details, and procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be provided. For switching operations in the 0.22–20 kV electricity network related to the works, the bidder must have a worker with valid switching authorisations who has been registered in Elektrilevi’s partner portal before the tenders are opened. For works limited to 0.22–1 kV, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the tenders are opened. The bidder must have a person managing the electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, has the relevant evidence at the time of tender submission, and is registered in Elektrilevi’s partner portal before the tenders are opened. The tender must comply with all tender document requirements; conditional tenders or tenders containing additional conditions are not permitted. The completed price table, including all unit prices, must be submitted, taking into account the instructions for completing management-system document V178. The bidder must provide the name, position, contact details and basis of authority of the contract signatory; if the authority does not arise from the articles of association, a power of attorney must be included. A contact person for contract performance matters must also be designated. Materials, equipment, goods or components produced in or originating from the Russian Federation or Belarus may not be used during the works; the contracting authority may request certificates of origin as evidence. The tender must identify any trade secrets and explain their designation, or state that it contains no trade secrets. The tender price and other figures used for evaluation may not be designated as trade secrets.
