Compliance requirements
A bidder will be excluded if the company, a member of its management or supervisory body, an authorised signatory, or another person with representative authority has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, or related offences. Exclusion also applies to convictions for enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions for employing a foreign national in Estonia, including paying less than the required wage, as well as offences involving the unlawful use of child labour or human trafficking. The bidder must not have outstanding state tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a material or repeated breach of a previous public contract, or for submitting false qualification information or failing to submit required information or documents. The bidder must confirm that none of these exclusion grounds apply. Companies established in the Russian Federation or the Republic of Belarus may not participate.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have had a value of at least EUR 150,000 excluding VAT. The bidder must provide a list of the contracts, including the completion period, details of the other contracting parties, the client’s contact details and, for public contracts, the reference numbers. At the contracting authority’s request, evidence of proper completion must be provided.
The team must include an employee with valid switching authorisations for the switching operations required in a 0.22–20 kV electricity network. If the works involve only low-voltage works, at least low-voltage switching authorisation is sufficient; in other cases, both low- and medium-voltage switching authorisations are required. The employee must be registered in Elektrilevi’s partner portal before the tenders are opened. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline.
The person managing the electrical works must hold, at the time of tender submission, a valid A-level competence certificate or a qualification corresponding to at least level 6 under the Estonian Professions Act, supported by relevant evidence. This person must also be registered in Elektrilevi’s partner portal before the tender submission deadline.
The tender must comply with all tender document requirements; conditional tenders or tenders containing additional conditions are not permitted. The tender must include a properly completed price table with all unit-price fields filled in, information on previous contracts, details of the contract signatory and contract-performance contact person, and, where necessary, a power of attorney. In the case of a joint tender, a power of attorney from the joint tenderers must be submitted. The bidder must confirm that the materials, equipment, goods and components used are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The bidder must identify and justify any trade secrets, but may not classify the tender price or prohibited numerical indicators related to evaluation as a trade secret. The standard payment period is 14, 35 or 45 calendar days depending on the contract value; participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
