The bidder must confirm that neither the bidder, its management or supervisory board members, procurists, nor persons authorised to represent or control it have been convicted of offences involving participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, breaching conditions for employing foreign nationals, illegal child labour, or human trafficking. The bidder must have no outstanding tax, payment or environmental charge debts, and awarding the contract must not breach international or Estonian sanctions. The bidder must also confirm that it is legally entitled to participate and does not breach any restriction imposed by the contracting authority concerning the company’s place of residence or establishment. Any required evidence and references to electronically available information must be submitted as required in the tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment, where registration is required by that country’s law. The bidder or the manufacturer it represents must have manufactured and marketed similar spare parts for at least 36 months. To demonstrate this, the bidder must submit a list of the most significant spare-parts supply contracts performed during the last three financial years, including quantities and customers. The tender must include a technical description of the proposed goods together with a drawing or sketch, and confirm that the goods are suitable for hopper wagons 12-132. Conditional tenders are not permitted, and the bidder must confirm acceptance of all conditions in the tender documents. Packaging used for delivery must be readily recyclable, made from renewable resources, or reusable; it must be possible to sort the packaging manually into recyclable components consisting of a single material.
