Procurement of TETRA handheld radios

The bidder must confirm that none of the exclusion grounds specified in sections 95(1), points 1–5, and 95(4), point 12, of the Estonian Public Procurement Act apply. For the exclusion check, the bidder must provide the name and personal identification code of any persons authorised to represent, make decisions for, or control the bidder who are not visible to the contracting authority in the commercial register, or confirm that there are no such persons. This requirement also applies, where relevant, to joint bidders, entities whose resources are relied upon, and branches of foreign companies.

The bidder’s total net turnover from all business activities must have been at least EUR 250,000 in each of the three most recently completed financial years. The bidder must provide turnover figures for those years and, if requested and the information is not available through a public register, submit the relevant annual accounts or extracts. If relying on another entity’s turnover, the bidder must provide that entity’s consent using Annex 3, stating the amount of turnover made available, committing to provide financial resources if needed for contract performance, and accepting joint responsibility for proper performance. Where joint bidders rely on one another’s resources, the bid must state the size and nature of the contract part each will perform, using Annex 4. The proposed handheld radios must meet the technical requirements in Annex 1. The bidder must submit technical product documentation, such as a product sheet or user manual, to demonstrate compliance. At the time of bid submission, the proposed model must be in the manufacturer’s active production and support cycle and part of its official product range. Any claimed equivalence must be explained and supported with evidence. The bid must comply with the tender documents, be unconditional, and present the price in the specified structure. For a joint bid, the bidders must appoint an authorised representative and submit the power of attorney in the form of Annex 4. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. Any information claimed as a trade secret must be identified and the claim justified; the bid price and other information that cannot legally be treated as a trade secret must not be designated as such.
