Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include convictions relating to participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, unlawful use of child labour or trafficking in human beings, as well as outstanding state taxes, public charges or environmental charges. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, or provided false information or failed to submit required information or documents concerning qualification. The bidder must not have its registered office or place of residence in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

Within the 60 months preceding the commencement of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties and the client's contact details, and, for public contracts, the procurement reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed. The bidder's team must include a person with the switching authorisations required for work on a 0.22–20 kV electricity network, registered in Elektrilevi's partner portal before the tenders are opened. For low-voltage works, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage works require switching on the medium-voltage side. The team must also include a person responsible for the work operation, registered in Elektrilevi's partner portal before the tender submission deadline. The person responsible for managing the electrical works must hold, at the time of tender submission, a valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Professional Qualifications Act, together with the relevant evidence, and must be added to Elektrilevi's partner portal before the tender submission deadline. The bidder must provide the details of the contract signatory and the contact person for contract performance; a power of attorney must be included where the signatory's authority does not arise from the articles of association. The tender must comply with all procurement document requirements, and conditional tenders or tenders containing additional conditions are not permitted. The tender must include the price table in the format specified in the procurement documents, with all unit-price fields completed. Materials, equipment, goods or components produced in or originating from the Russian Federation or the Republic of Belarus may not be used in the works; the contracting authority may request certificates of origin. The bidder must identify and justify any trade secrets in the tender or state that the tender contains no trade secrets.
