The successful bidder must confirm that none of the exclusion grounds specified in § 95(1) of the Estonian Public Procurement Act apply. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. A tender leading to a contract that would be void under § 7(1) of the International Sanctions Act will be rejected. If the tender is submitted jointly, the joint bidders must appoint an authorised representative from among themselves and submit the relevant power of attorney. The bidder must identify any trade secrets in the tender and provide reasons for the classification; the tender price and other information that may not be classified as a trade secret must not be marked as such.

The bidder must submit a completed technical tender form and price submission in the structures specified in the tender documents. Product data sheets and other supporting materials must be provided to demonstrate compliance with the technical specification and substantiate the information in the technical tender. The bidder must submit maintenance plans for the offered device for both the warranty and post-warranty periods, including descriptions of the work, the time required and the frequency of maintenance. The bidder must be the official representative of the manufacturer of the offered device in Estonia and must provide an authorisation letter, certificate or another equivalent document proving the right to sell or represent the device. During contract performance, both during and after the warranty period, the bidder must have a qualified service engineer or technician in its service team who has received manufacturer training for maintaining and repairing the offered device. The tender must comply with all tender-document requirements, must not be conditional, and any claimed equivalence must be explained and supported by appropriate evidence. The required price submission form must also be completed and submitted.
