Compliance requirements

A tenderer may be excluded for knowingly submitting false information or forged documents where this affects the assessment of its qualification, tender compliance or successful tender. Exclusion may also result from failure to provide requested explanations or evidence within the specified deadline, a competition-distorting agreement, or an unresolved conflict of interest. The tenderer must confirm that it is not subject to any participation restriction imposed by the contracting authority based on the company’s place of establishment or residence, and must provide electronic source details where required.

Qualification criteria and exclusion grounds

The tenderer’s annual net turnover must have been at least EUR 2,000,000 in each of the three financial years preceding the procurement. During the 60 months before the tender submission deadline, the tenderer must have properly completed at least three agricultural production or storage buildings, each with a built-up area of at least 750 m². Each reference project must be completed and have an issued occupancy permit. For each reference, the tenderer must provide the project name, location, intended use, built-up area, description of the works, performance period, client name, and the name and contact details of the client’s contact person. The contracting authority may verify the information with the client. For contract performance, the tenderer must provide a project manager who is at least a level 7 certified construction engineer with competence in construction management, or an equivalent professional qualification, and at least three years of relevant experience managing construction works. The tenderer must submit the project manager’s name, certificate number or equivalent qualification evidence, certificate validity, and a description of at least three years of relevant work experience. The tender must comply with all tender document requirements, and conditional tenders are not permitted. Where applicable, equivalence must be explained and supported by evidence. The tenderer must identify and justify any trade secret in its tender; the tender price and figures affecting the assessment of construction works may not be classified as trade secrets.
