Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions involving the bidder or its management, supervisory bodies, procurist or other authorised representatives, including participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment or breaches of foreign workers’ employment conditions, including payment below the statutory wage; unlawful child labour or trafficking in human beings; and outstanding national taxes, charges or environmental fees, or tax or social-security debts under the law of the bidder’s country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required qualification information or additional documents.
The bidder must confirm that its registered office or residence is not in the Russian Federation or Belarus. Materials, equipment, goods and components manufactured in or originating from Russia or Belarus may not be installed or used during the works. The contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the launch of the procurement. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the contracting party’s representative and contact details, and the procurement reference numbers where applicable. Evidence of proper performance must be provided upon request unless the contracting authority can obtain it from public or private databases without significant additional cost.
The team must include a person with valid switching authorisations for the relevant 0.22–20 kV electrical network operations, registered in Elektrilevi’s partner portal before the tender deadline. For low-voltage-only works, at least MP switching authorisations are required; in other cases, both MP and KP switching authorisations are required, including where low-voltage works require switching on the medium-voltage side. The team must also include a person responsible for the work operation, registered in the partner portal before the tender deadline, and a person leading the electrical works with valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, holding the relevant certificate and registered in the portal before the deadline.
The bid must accept all procurement document conditions, may not contain additional or conditional terms, and must include a fully completed price table in the required format. The bidder must provide the names, positions and contact details of the contract signatory or signatories and the contract-performance contact person; a power of attorney is required if signing authority does not arise from the articles of association. The bidder must also state and justify any trade secrets. The applicable payment term must be accepted: 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, or 45 days for contracts of EUR 250,000 or more; participation in the factoring programme results in a 95-day payment term.
