Ski-track maintenance services

The bidder and its representatives must not be subject to exclusion grounds, including a final conviction within the last five years, or a still-effective exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking offences. The bidder must not have outstanding tax or social-security obligations. It must not be bankrupt, in liquidation, subject to insolvency proceedings or a similar situation, or have its business activities suspended. It must also not have seriously breached previous contracts in a way that resulted in early termination, compensation or a contractual penalty. Exclusion may also apply for breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing the procurement, or the submission of false information or failure to provide required documents. The authority will also check unlawful employment of foreign nationals, the application of international sanctions and convictions for tax offences. The bidder must provide the required declarations and, where requested, supporting evidence; false or incomplete information may lead to exclusion.

The bidder must have, throughout the contract period, the equipment needed to prepare and maintain ski tracks or the right to use such equipment. The bid must include a list of the tools and equipment. If the equipment is not owned by the bidder, a valid written agreement must be submitted proving the right to use it for contract performance. The bidder must involve at least one person responsible for service delivery who has practical experience preparing and maintaining ski tracks for at least one ski season. The bid must state that person’s name, the period of experience, the name or location of the maintained ski track or tracks, a brief description of the work performed, and the name and contact details of the client, employer or other person able to verify the experience. The contracting authority may verify the information provided. For a joint bid, a power of attorney for the joint bidders must be attached. The bidder must confirm that it will not use a subcontractor who would be subject to replacement under Section 122(7) of the Estonian Public Procurement Act. The bid must comply with all tender-document requirements; conditional bids are not allowed. The price must be submitted in the structure prescribed in the tender.
