Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or its relevant managers, supervisory body members or authorised representatives have, within the last five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Declarations also cover breaches of tax or social security payment obligations; environmental, social or labour law violations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; competition-distorting agreements; conflicts of interest; involvement in preparing this procurement where an advantage cannot otherwise be remedied; and significant or repeated breaches of previous contracts resulting in early termination, damages, price reduction or penalties. The bidder must also declare whether it has provided false or misleading information, withheld required information or documents, failed to submit requested supplementary documents promptly, or improperly sought confidential information or influence over the procurement. National grounds include enabling the unlawful employment of a foreign national, being subject to an applicable international or government sanction, tax offences, local tax debt in the contracting authority’s location, and any restriction on participation based on the bidder’s place of establishment. Where applicable, the bidder may describe measures taken to restore its reliability. For tax debts, the notice states that a tax-debt certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been rescheduled; foreign bidders are assessed under the law of their country of establishment.

Qualification criteria and exclusion grounds

The bidder must submit a work plan in free format that addresses the requirements of Article 5 of the Urban Wastewater Treatment Directive (EU) 2024/3019 and complies with the mandatory requirements in the technical specification and evaluation methodology. Submitting the contracting authority’s technical specification as the bidder’s own description is not acceptable. The work plan will be assessed under the award criterion “Description of the work to be performed”; the evaluation methodology is set out in a separate document. The service team must include at least three people: a project manager, a legal expert and a water management/sewerage expert. Submit the completed team information form and copies of education documents. The information and CVs must be sufficiently detailed to verify compliance with the tender documents. Each team member must consent to being named and participating in contract performance, and the bidder must hold each member’s written consent to processing their personal data. For a joint tender, the members must appoint an authorised representative and include the power of attorney with the tender. The tender must be unconditional, comply with the tender documents and present its price in the prescribed structure. The bidder must identify any trade secrets and explain why they qualify; price and other specified evaluation-related figures may not be classified as trade secrets. During contract performance, only subcontractors and suppliers established in Estonia, another EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement may be used. First-tier subcontractors will be checked and must submit a European Single Procurement Document. No specific financial-capacity or prior-experience thresholds are stated in the provided material.
