Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if a ground for exclusion under points 4 or 5 of subsection 1 of section 95 of the Estonian Public Procurement Act applies. The bidder must submit the required declaration confirming that the ground in point 5 does not apply. For bidders registered in Estonia, the contracting authority will check independently whether there are tax arrears. A bidder registered abroad must submit a certificate from the competent authority in its country confirming the absence of tax arrears. The certificate, accompanied by an Estonian translation, must reflect the situation as at the end of the quarter preceding publication of the contract notice or a later date.

Qualification criteria and exclusion grounds

The bidder must be registered in the relevant business register in its country of establishment. The contracting authority will check the registration of Estonian bidders; a bidder registered abroad must submit a certified extract from the relevant register, with an Estonian translation. During the 36 calendar months preceding publication of the contract notice, the bidder must have completed at least one similar contract for the supply of at least 200 tonnes of polyaluminium chloride under a single contract. The bidder must provide information about the completed contract, including the other contracting party, start and end dates, quantity supplied and contract value, using the required experience form. The bidder must hold the permits and registrations required by law to sell and transport chemicals and be able to deliver the chemical in accordance with the technical specification. It must provide the required delivery-conditions declaration and, where necessary, copies of relevant documents. The bid must include manufacturer-issued documentation specifying the proposed chemical and confirming compliance with the technical requirements in sections 3.1–3.8 of the tender documents. A bidder whose bid is signed by a person not recorded as an authorised representative in the Estonian business register must provide a power of attorney; foreign bidders must provide evidence of representation authority with an Estonian translation. Joint bidders must appoint an authorised representative from among themselves and submit the required joint-bidder power of attorney. The bid must comply with all tender-document conditions; conditional bids are not permitted. The price must be submitted in the required structure. The bid must remain valid for at least two months from the submission deadline, and the required bidder declaration must be included. Any information designated as a trade secret must be identified and the designation justified; the bid price and other information that may not be treated as a trade secret under the law must not be so designated.
