Compliance requirements
A bidder may be excluded if, within the previous five years or while an exclusion period remains in force, it or a person representing, managing or controlling it has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include breaches of tax or social security payment obligations; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, a comparable legal situation, administration of assets by a liquidator or court, or suspended business activities; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing this procurement that creates an advantage which cannot otherwise be prevented; and serious or persistent failure to perform an earlier public contract, resulting in termination, a price reduction, damages or a penalty. Exclusion may also apply for false or withheld information, failure to provide requested supporting documents, improper attempts to influence the procedure or obtain confidential information, enabling the unlawful employment of a foreign national or breaches of foreign workers’ employment conditions, including payment below the statutory wage rate, tax-related offences, applicable international sanctions, or a restriction on the bidder’s right to participate based on its place of establishment. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The procurement has two lots. For Lot 1, the bidder must submit a confirmation, certificate or other document issued by SAP or an SAP-authorised party showing that it is entitled to provide SAP ERP maintenance and support services in Estonia. For Lot 2, equivalent evidence is required for SAP BI maintenance and support services in Estonia. The bidder must also provide the names and personal identification codes of authorised representatives who are not listed in the commercial register, or confirm that it has no such representatives. Joint bidders must appoint an authorised representative and include a power of attorney with the bid.
The bid must comply with the tender documents, be unconditional and present its price in the specified structure. Where equivalence is relevant, the bidder must explain it and provide supporting evidence. The bidder must identify any information claimed as a trade secret and explain the claim; the price and other specified evaluation-related figures may not be marked as trade secrets. The bidder must confirm compliance with environmental requirements: deliver materials digitally where practicable, keep digital files to an appropriate size and promptly delete unnecessary drafts and working documents; where printing is needed, prefer products with a Type I ecolabel.
During contract performance, the bidder may use only subcontractors and suppliers established in Estonia, another EU Member State, an EEA contracting state or a party to the WTO Agreement on Government Procurement. The bidder must also confirm that it will not involve subcontractors or suppliers covered by the stated EU sanctions restrictions concerning Russia for more than 10% of the contract value. No financial-capacity or prior-experience thresholds, or detailed award-scoring criteria, are specified in the available tender information.
