Compliance requirements
The notice covers exclusion grounds including final convictions within the past five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. It also addresses breaches of tax and social-security payment obligations; environmental, social and labour-law obligations; bankruptcy, insolvency, liquidation, creditor arrangements, suspended business or comparable situations; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing the procurement where the resulting distortion cannot otherwise be avoided; serious or repeated failures under earlier public contracts; and false or misleading information, failure to provide information or requested documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds include enabling unlawful employment of a foreign national, being subject to international sanctions, relevant local tax debt, tax-related convictions, and restrictions on who may participate based on place of establishment. The tenderer must also confirm that it is not subject to applicable exclusion grounds. Where the rules allow it, evidence of measures restoring reliability may be provided.
Qualification criteria and exclusion grounds
**Selection and compliance requirements**
- **Lot 1 – occupational health services for municipal institutions:** Within the 36 months preceding the start of the procurement, the tenderer must have completed at least one occupational health services contract under which health examinations were carried out for at least 1,500 employees. Submit a list of contracts with dates, values and client details, including the client representative’s name and contact information and, for public procurements, the reference number.
- The tenderer must have at least one service location in Tallinn. The procedures and analyses included in the service packages must be performed at one location, except for executive health audits. Additional Tallinn locations earn extra evaluation points.
- The tenderer must hold a Health Board licence for each service location named in its tender. Any subcontractor providing occupational health services must also hold the relevant licence.
- **Lot 2 – mobile health bus for Iru Care Home:** Within the 36 months preceding the start of the procurement, the tenderer must have completed at least one occupational health services contract under which health examinations were performed in a health bus for at least 60 employees. Submit a list of contracts with dates, values and client details, including the client representative’s name and contact information and, for public procurements, the reference number. The tenderer and any subcontractor providing occupational health services must hold a Health Board licence for service delivery in a health bus.
- For both lots, the tenderer must have an Estonian-language online self-service platform. Include the relevant lot-specific form confirming that it meets the functionality specified in the technical description.
- Prices must follow the prescribed pricing structure. Provide the unit prices and total price in the applicable annex to two decimal places. Unit prices must include all costs related to delivering the service and must not be zero or negative. If the amounts in the pricing forms differ from those entered in the procurement register, the amounts in the pricing forms prevail. Conditional tenders are not permitted.
- Offering a REST API web service is optional. Not offering one does not make the tender non-compliant, but earns 0 evaluation points for that feature. The tender must comply with the procurement documents; any claimed equivalence must be explained and supported with evidence. Joint tenderers must appoint an authorised representative and include their power of attorney. The tenderer must identify and justify any information claimed as a trade secret; prices and figures used in tender evaluation cannot be classified as trade secrets.
