Compliance requirements
The bidder will be excluded if it, or a person authorised to represent, manage, supervise or control it, has been convicted of participation in a criminal organisation, breach of professional integrity or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing, enabling unlawful employment of a foreign national or breaches concerning the terms of their employment in Estonia, or unlawful use of child labour or human trafficking. The bidder will also be excluded for outstanding state tax, duty or environmental charges, or tax or social security contribution arrears under the law of its country of establishment.
The contracting authority may exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to submit that information or requested supporting documents.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement. At least one contract must have been worth €40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party and its representative’s contact details, including telephone number and email address, and the procurement reference number for public contracts. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The bidder must have an electricity works manager with a valid A-level competence or a qualification of at least level 6 under the Professions Act. The person must hold evidence of the qualification by the bid deadline and be registered in Elektrilevi’s partner portal before bids are opened. The bidder must also have a worker with valid switching rights for switching operations related to the works in the 0.22–20 kV electricity network, excluding regional and distribution substations, registered in the partner portal before bids are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person responsible for the work operation, registered in the partner portal before bids are opened.
The bid must comply with the procurement documents without additional or conditional terms. The price must be submitted using the provided table, with every unit-price field completed. The bidder must provide the name, title and contact details of each contract signatory and of the contract-performance contact person; if the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bidder must identify and justify any information claimed as a trade secret; prices and specified bid-evaluation figures cannot be designated as trade secrets.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days.
Companies established in Russia or Belarus may not participate. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
