Compliance requirements
The bidder must confirm that no mandatory exclusion grounds apply. These include relevant convictions of the bidder or its authorised representatives for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, child labour or human trafficking; outstanding tax, social security or environmental levy debts; and circumstances in which awarding the contract would breach international or Estonian sanctions. Foreign bidders must provide equivalent criminal-record and tax-debt evidence from the competent authorities in their country of establishment.
The buyer may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency or comparable circumstances; serious professional misconduct; anti-competitive conduct; an unmanageable conflict of interest or an advantage arising from involvement in preparing the procurement; significant or repeated breach of an earlier public contract; false or misleading information or failure to provide requested evidence; attempts to improperly influence the buyer or obtain confidential information; relevant tax-offence convictions; or lack of the legal right to submit a bid. The bidder must also confirm whether it breaches any restriction imposed by the buyer on participation based on the bidder’s country of establishment or location.
Qualification criteria and exclusion grounds
The bidder must be entitled to sell gas by the submission deadline, through the required economic activity notice, registration or licence under the law applicable in its country. For a foreign bidder, provide evidence of the registration or licence, or a public register link that allows the buyer to verify it. If the bidder’s country does not require such registration or a licence, provide a confirmation explaining this.
During the 36 months preceding the start of the procurement, the bidder must have duly performed at least one natural gas sales contract under which at least 50,000 m³ of gas was delivered to the buyer during that period. For the reference contract, provide the buyer’s name and contact person’s email address and telephone number, the performance period, the actual quantity delivered during the reference period, a brief description of the contract and, if it was awarded through a public procurement, its reference number. An ongoing contract may be used, and it may have been signed before the 36-month period; only gas actually and duly delivered during that period counts.
If submitting a joint bid, the bidders must appoint an authorised representative from among themselves and include the authorisation. The bid must be unconditional, comply with the tender documents and present its price in the structure specified in the pricing schedule. Any claimed equivalence must be explained and supported by evidence. The bidder must identify and justify any trade secrets; prices and other specified evaluation-related figures may not be designated as trade secrets. The bid must be submitted by the bidder’s legal or authorised representative; where the submitter’s authority is not evident from the relevant register, provide an authorisation or other evidence of representation. No award criterion or scoring details are specified in the available document text.
