The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives has, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful child labour or human trafficking offences. Compliance with tax and social security payment obligations and the existence of tax debt are also checked; the notice specifies a EUR 100 threshold and an exception for deferred tax debt. The exclusion grounds also cover bankruptcy, liquidation or insolvency proceedings, an agreement with creditors, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement procedure, early termination or sanctions resulting from a material breach of a previous contract, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour-law obligations is also checked. Under Estonian law, the procedure additionally checks whether the bidder has enabled an unlawfully staying foreign national to work, whether international sanctions apply, and whether the bidder has been convicted of tax offences. Where an exclusion ground exists, the bidder may provide evidence of remedial measures restoring its reliability if that possibility applies to this procurement.

The bidder must have previous experience in the manufacture and/or sale of computed tomography scanners. During the 36 months preceding the start of the procurement, the bidder must have properly performed at least one supply contract or order for a product comparable to the subject of the procurement, with a value of at least EUR 100,000. The bidder must provide details of the contract or order, including its value, dates, contracting authority and contact details, and the bidder’s scope of responsibility. The bidder must ensure that an manufacturer-approved sales representative is available in the Republic of Moldova for the offered equipment, so that user training, maintenance and repairs are available at the end user’s location. This must be evidenced by a manufacturer’s confirmation stating the representative’s name, address, contact person and contact details. The tender must comply with the tender documents, be unconditional and follow the required bid price structure. A properly completed compliance matrix and technical tender form must be submitted. If the offered solution differs from a referenced standard, technical approval, trademark or other technical basis, the bidder must explain its equivalence and provide supporting evidence. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The bidder must also not involve subcontractors or suppliers accounting for more than 10% of the contract value who are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives of or persons acting under the instructions of such persons or entities. In a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must also provide the signatory’s details and the bank details required for contract conclusion.
