Supply of a CT scanner to Moldova

A bidder may be excluded for specified final convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, including convictions of persons who manage, represent or control the bidder. Other grounds include tax or social-security arrears; bankruptcy, insolvency, liquidation or a comparable situation; suspended business activity; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; or serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions. Exclusion may also apply for breaches of environmental, social or labour obligations, false or misleading information, failure to provide required information or documents, improper attempts to influence the procurement or obtain confidential information, enabling unlawful employment of a foreign national, or conviction for tax offences. A bidder may also be excluded if awarding the contract to it would breach an international or Estonian government sanction. The bidder must have experience in the manufacture and/or sale of CT scanners and must have properly completed, during the 36 months preceding the start of the procurement, at least one supply contract or order for a comparable product worth at least €100,000. The bidder must provide details of the reference, including its value, dates and customer. The bidder must submit a completed compliance matrix and technical tender form. The offer must comply with the tender documents; if an equivalent product or solution is offered, its equivalence must be explained and supported by evidence. The offered goods must not be subject to international sanctions or originate from a sanctioned region. The bidder must provide the manufacturer’s confirmation that an approved sales representative for the offered product operates in Moldova, including the representative’s name, address and contact details. The offer must also include the signatory’s name and contact details, the basis of their authority to represent the bidder, and the bidder’s bank details. If submitting a joint bid, the bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must identify any trade secrets and explain why the information qualifies as such; bid prices and other specified evaluation figures may not be classified as trade secrets. Conditional tenders are not permitted, and the price must follow the structure specified in the tender documents. The bidder must confirm that subcontractors and suppliers covered by the EU restrictions relating to Russia will not account for more than 10% of the contract value.
