Compliance requirements
A bidder may be excluded for relevant final convictions of the bidder or its management, supervisory or representative persons, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspension of business or similar situations; serious professional misconduct; agreements distorting competition; conflicts of interest that cannot otherwise be resolved; involvement in preparing the procurement where an advantage cannot otherwise be remedied; early termination or sanctions for serious or repeated breaches of previous contracts; false or misleading information, withholding information, failure to provide requested documents or improperly obtaining confidential information. National grounds include enabling the unlawful employment of a foreign national, contracting with a person subject to international sanctions, and relevant tax-crime convictions. The tax-authority certificate exception applies where the debt is below EUR 100 or payment has been deferred. Where applicable, a bidder may provide evidence of measures taken to restore its reliability.
