Compliance requirements
The bidder must confirm that neither the bidder nor its representatives or members of its management and supervisory bodies has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal employment of children or human trafficking-related offences. Compliance with tax and social security payment obligations is also checked.
The exclusion grounds also cover breaches of environmental, social and labour law obligations; bankruptcy, liquidation or another insolvency situation; administration of assets by a liquidator or court; suspended business activity; serious professional misconduct; agreements restricting competition; an unavoidable conflict of interest; involvement in preparing the procurement in a way that creates an unjustified advantage; and serious breaches of previous public contracts. False information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the contracting authority may also lead to exclusion.
Additional national grounds concern enabling the employment of an unlawfully staying foreign national, breaches of international or Estonian sanctions, and convictions for tax offences. Where an exclusion ground exists, the bidder may describe measures taken to restore its reliability if remedial measures are permitted for this procurement.
Qualification criteria and exclusion grounds
The machine-readable notice did not specify precise qualification or financial capacity requirements, such as minimum turnover or previous experience thresholds; these must be checked in the tender documents.
To demonstrate compliance of the tender, the bidder must submit:
- a brief description of the activities and the expected work schedule;
- documents proving that the lift to be designed and installed complies with the technical requirements, such as brochures, photographs, certificates or other relevant documentation;
- the detailed tender price table using the contracting authority’s prescribed form (Form 1).
The tender must comply with all tender document requirements, must be unconditional, and the price must be presented according to the prescribed structure. Where necessary, an equivalent solution must be explained separately and evidence of equivalence must be attached.
The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers connected with sanctioned Russian entities, and will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act. In a joint tender, a power of attorney from the joint tenderers must be submitted. The bidder must identify and justify any trade secrets or confirm that the tender contains none; the tender price and figures characterising the tender against the award criteria may not be classified as trade secrets. During contract performance, first-tier subcontractors will be checked, but subcontractors are not required to submit a European Single Procurement Document.
