Compliance requirements

The bidder must not have mandatory exclusion grounds, including relevant convictions of the bidder or persons authorised to represent, manage or control it for organised crime, dishonesty or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals or breaches of their employment conditions, or unlawful child labour or human trafficking. The bidder must also have no outstanding national tax, payment or environmental-charge debt, or tax or social-security contribution debt under the law of its country of establishment. The contracting authority may also exclude a bidder for materially or repeatedly breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information or failing to submit required information or documents concerning qualification. The bidder must confirm that the exclusion grounds do not apply. Companies established in Russia or Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the procurement subject during the 60 months preceding the start of the procurement. At least one contract must have been worth €150,000 or more, excluding VAT. The bidder must provide a list stating the performance period, the other contracting party’s details (including the client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it without significant cost from public or private databases. The bidder’s team must include, and have registered in Elektrilevi’s Partner Portal (EPP) before the tender submission deadline: a worker with the switching rights required for the relevant electrical network works; a designated person responsible for work operations (C-person); and a person leading electrical works with valid A-class competence or a qualification of at least level 6 under the Vocational Qualifications Act, supported by evidence. For works involving only low voltage (0.22–1 kV), low-voltage switching rights are sufficient. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. Switching rights must be obtained in accordance with the specified training procedure. The bid must comply unconditionally with the tender documents and include a completed price table in the required format, with every unit-price field filled in. The bidder must provide the authorised signatory’s name, title and contact details, and a contract-performance contact’s details; a power of attorney must be included if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and provide an authorisation document. The bidder must also identify and justify any information claimed as a trade secret. Russian- or Belarusian-origin materials, equipment and goods may not be used in the works; the contracting authority may request certificates of origin.
