The bidder must confirm that none of the exclusion grounds under § 95(1), points 1–5, or § 95(4), point 12, of the Estonian Public Procurement Act apply. For checks concerning persons authorised to represent, make decisions for, or control the bidder (including joint bidders, relied-upon entities and branches of foreign companies), the bidder must provide the name and personal identification code of any such person not shown in the commercial register, or confirm that there are no such persons.

The bidder must have total net turnover of at least EUR 500,000 in each of its three most recently completed financial years. It must provide the turnover figures in the procurement register and, if the figures are not available from a public register, submit the relevant annual accounts or extracts on request. If relying on another entity’s turnover, the bidder must provide that entity’s consent using Annex 4, including its commitment to provide financial resources if needed and to accept joint responsibility for proper contract performance. Where joint bidders rely on one another’s resources, the bid must state the size and nature of the contract portion each will perform and include the information in Annex 5. The bidder must hold Cloud Service Provider (CSP) status and provide evidence of it. It must also have at least one Microsoft Corporation licensing specialist available to provide consultation to the contracting authority and able to communicate in Estonian. The applicable software producer licence terms must be submitted with the bid. Joint bidders must appoint an authorised representative and submit the authorisation using Annex 5. The bid must comply with the procurement documents; conditional bids are not permitted. Pricing must follow the prescribed structure, including the completed Annex 3 price form, and unit prices must remain fixed throughout the contract period. If claiming equivalence, the bidder must explain it and provide supporting evidence. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions.
