Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions of the bidder or its management, supervisory body members, procurist or other authorised representatives; enabling unlawful employment or employment of foreign nationals in breach of applicable conditions, including payment below the statutory wage rate; unlawful use of child labour or human trafficking; outstanding state tax, payment or environmental charges, or tax and social security arrears under the law of the bidder’s country; and circumstances where awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or has submitted false information or failed to provide required qualification information or additional documents. The bidder must confirm that it is not established or resident in the Russian Federation or Belarus. Russian- or Belarusian-origin materials, equipment, goods and components may not be installed or used in the works, and certificates of origin may be requested.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must submit extracts from the relevant annual reports showing the turnover, unless the information is publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the requirement applies to the three most recently completed financial years, and at least six months must have elapsed since the end of the last completed financial year by the tender submission date.
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one of those contracts must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s details and the client representative’s telephone number and email address, as well as procurement reference numbers for public contracts. Evidence of proper performance must be provided upon request unless the information can be obtained from public or private databases without significant expense.
The bidder must have, by the tender submission date, a person responsible for leading electrical works who holds valid A-level competence and/or a qualification corresponding to at least level 6 under the Professional Qualifications Act, with supporting evidence recorded in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person with valid switching rights for work-related switching operations in 0.22–20 kV electrical networks, registered in the partner portal before tenders are opened. For low-voltage-only works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where medium-voltage-side switching is needed for low-voltage works. A person responsible for the work operation must also be appointed and registered in the partner portal before tenders are opened.
The tender must comply with all procurement documents and may not contain additional or conditional terms. The price must be submitted using the required price table, with every unit-price field completed, and the price must include the estimated 70 m² scope for restoration of landscaping. The bidder must provide the name, position and contact details of the contract signatory or signatories and a contract-performance contact person; a power of attorney must be attached if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must also state and justify any trade secrets, while the tender price and other prohibited evaluation-related figures may not be classified as trade secrets.
