Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it, or any member of its management, supervisory or governing bodies or authorised representative, has been convicted within the relevant period (generally the last five years) of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation or comparable situations; suspension of business; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; improper involvement in preparing the procurement; significant or repeated breach of an earlier public contract; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the contracting authority. Exclusion may also apply for unpaid taxes or social security contributions. The stated threshold is EUR 0; however, under Estonian rules, a tax-debt certificate is not issued where the relevant unpaid tax debt is below EUR 100 or payment has been deferred. Mandatory national grounds include enabling an unlawfully present foreign national to work or breaching rules on foreign workers’ employment conditions, and contracting with an entity in breach of international or Estonian government sanctions. Convictions for tax offences are a discretionary national ground. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. The bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or under their direction.

Qualification criteria and exclusion grounds

The bidder must hold the handling permit required under the Ambient Air Protection Act and be registered in the Environmental Board’s FOKA register. The registration must be verifiable in the register or through the information provided. The bidder’s average net turnover from the installation, maintenance and repair of ventilation and cooling equipment must have been at least EUR 195,000 during the period 1 January 2023 to 31 December 2025. The bidder must have at least three years of experience maintaining or repairing ventilation units with a capacity of at least 10,000 l/s, and at least three years of experience in ventilation cooling. For each year, provide details of one maintenance or repair contract for a qualifying ventilation unit and one ventilation-cooling maintenance contract, including the client’s name and contact details. At least six completed works are required in total. The team must include a works manager with at least Estonian professional qualification level 5 in construction of indoor-climate systems, and at least two employees with at least level 4 refrigeration mechanic qualifications. Provide information demonstrating the relevant qualifications. The bid must comply with the tender documents; conditional bids are not permitted. Submit the price in the prescribed structure and complete the price table in Annex 3. If amounts in Annex 3 differ from those in the price form in the procurement register, the amounts in the register’s form prevail. If relying on equivalence, explain it and provide supporting evidence. Joint bidders must appoint an authorised representative and include the relevant power of attorney. Identify any trade secrets in the bid and explain why they qualify as such. The bid price, component prices and other numerical figures used to evaluate service bids may not be designated as trade secrets. The bidder must confirm that it will not use a subcontractor who is subject to mandatory replacement under the applicable rules. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
