Compliance requirements
Exclusion grounds include convictions of the bidder or members of its management, administrative or supervisory bodies for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour, or human trafficking. They also include failure to pay taxes or social security contributions. For tax arrears, a threshold of EUR 100 is specified: the tax authority does not issue an arrears certificate where the debt is below that amount, and rescheduled tax debts are also addressed.
Further grounds may include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, an agreement with creditors, assets administered by a liquidator or court, suspension of business activity, serious professional misconduct, agreements distorting competition, conflicts of interest, involvement in preparing the procurement, material or repeated breach of a previous public contract, and submission of false information or failure to provide required information or documents. National grounds also cover enabling a foreign national to work while unlawfully present in the country, being subject to international sanctions, and conviction for tax offences. In certain circumstances, the bidder may submit evidence of measures taken to restore its reliability.
