Purchase of frozen products

The tenderer must confirm that neither the tenderer nor its relevant representatives has been convicted within the applicable period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The tenderer must not have outstanding tax or social security payment obligations. The exclusion grounds also cover bankruptcy, insolvency or liquidation proceedings, assets administered by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing the procurement, serious or repeated breaches of previous public contracts, and the submission of false or misleading information or failure to provide required documents. The tenderer must also confirm compliance with environmental, social and labour-law obligations, the absence of relevant domestic offences, compliance with international sanctions and any applicable restrictions based on the tenderer's place of establishment. Where an exclusion ground applies, the tenderer may provide information about remedial measures where legally permitted. The tenderer must be able to provide the required confirmations and supporting evidence when requested.

The tenderer must be registered in the relevant commercial register in its country of establishment. This requirement applies to all three lots: frozen vegetables, frozen berries and frozen fish. The registration number and, where requested, proof of registration must be provided. The tender must comply with the technical description in Annex 1, contain all required product data and prices in the prescribed spreadsheet format, and include any additional information needed to verify compliance. The tenderer must submit the required tender statement and authorisations where applicable. For a joint tender, the joint tenderers must appoint an authorised representative and submit the original authorisation. If the tender is submitted or signed by a person who is not the tenderer's statutory representative, the relevant powers of attorney must be included.
