Compliance requirements
Mandatory exclusion applies where the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment or working conditions of foreign nationals, including payment below the statutory wage rate; or unlawful use of child labour or human trafficking. A bidder with outstanding state tax, contribution or environmental charges, or tax or social-security contribution debts under the law of its country of establishment, is also excluded.
The contracting authority may also exclude a bidder for materially or repeatedly breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to provide such information or requested supplementary documents. Enterprises established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties and their representatives’ contact details, including telephone number and email address, and procurement reference numbers where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The team must include:
- A switching operator with valid switching rights for the relevant works on 0.22–20 kV networks, registered in Elektrilevi’s partner portal before the bid deadline. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The applicable training procedure is set out in document J387.
- A person appointed to be responsible for the work operation, registered in Elektrilevi’s partner portal before the bid deadline. The relevant requirements are set out in documents J31 and J3284.
- A person leading electrical works who, at the time of submission, holds valid A-class competence and/or a qualification of at least level 6 under the Professions Act, has the corresponding evidence and is registered in the partner portal before the bid deadline.
The bid must include a price table using the form in the procurement documents, with every unit-price field completed. Bidders must also take account of the completion instructions for control-system document V178. The bidder must identify the contract signatory or signatories, their titles and contact details, and the contact person for contract-performance matters; a power of attorney must be included if signing authority does not arise from the articles of association. The bidder must identify any information claimed as a trade secret and justify that designation; prices and other specified evaluation-related figures may not be treated as trade secrets. Materials, equipment and goods, including components, installed or used in the works must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin. Standard payment periods are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. No award criteria are specified in the provided documents.
