Compliance requirements
Exclusion may apply where the bidder or its representatives have, within the previous five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, administration of assets by a liquidator or court, suspended business activities, or a similar situation; serious professional misconduct; agreements intended to distort competition; an unresolved conflict of interest; involvement in preparing the procurement that creates an unpreventable competitive advantage; early termination or comparable sanctions for a previous contract; and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly.
National grounds also include enabling a foreign national to work without a legal basis or in breach of employment conditions, being subject to an international sanction, conviction for tax offences, local tax arrears where applicable, and lack of legal entitlement to submit a bid. A tax debt below EUR 100, excluding interest not established by an administrative act, or a debt whose payment has been rescheduled is treated as specified in the notice. Where permitted, a bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the parking management field must have been at least EUR 40,000 in each of the last three financial years, 2023–2025.
Within the 36 months preceding the start of the procurement, the bidder must have completed at least one paid parking management contract. By the time bids are submitted, the contract must have been performed continuously for at least 18 months and must have involved operating at least 50 marked or otherwise identified Category B parking spaces. The bidder must provide a list of relevant contracts, including car park names, contract dates, the number of marked Category B spaces operated, the customer’s representative’s contact details (including telephone number and email address), and procurement reference numbers where applicable.
The bid must follow the pricing structure specified in the pricing schedule and must offer monthly rent of at least EUR 800. Conditional bids are not permitted; submitting a bid confirms acceptance of the tender documents. Joint bidders must appoint an authorised representative and provide a power of attorney. The bidder must identify any trade secrets in the bid and justify that designation; prices and other specified evaluation-related figures may not be classified as trade secrets.
The bidder must confirm that it will not engage, for more than 10% of the contract value, subcontractors or suppliers covered by the applicable EU Russia sanctions restrictions. It must also confirm that it will not engage a subcontractor subject to replacement under the applicable procurement rules. The required declarations concerning international sanctions must be provided.
