Compliance requirements

The bidder must declare whether it, or any person in its management, supervisory or representative bodies, has relevant convictions within the preceding five years, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; and serious or persistent failures under previous contracts resulting in early termination, damages or comparable sanctions. Grounds also cover false or misleading information, failure to provide required information or supporting documents, attempts to improperly influence the procurement or obtain confidential information, enabling unlawful employment of a foreign national, being subject to an international sanction, relevant tax offences, local tax arrears where applicable, and restrictions on the right to participate based on the bidder’s place of establishment. Where a ground applies, the bidder may provide information about remedial measures where permitted. Qualification criteria and exclusion grounds

The bidder must have civil liability insurance of at least EUR 20,000 covering personal injury and property damage caused to third parties and the contracting authority’s property. The insurance must remain in force throughout the contract period; the bidder bears the deductible and insurance costs and must not cancel or compromise the cover. Evidence must be provided after the bid is declared successful, and further evidence may be requested by the contracting authority. During the 36 months before the procurement notice was published in the register, the bidder must have completed at least three contracts for cleaning buildings or indoor premises, each worth at least EUR 20,000 excluding VAT. The bidder must provide details of the contracts, including their value, dates and clients. The bid must comply with the tender documents, use the prescribed price structure and not be conditional. The bidder must visit the contract site before submitting a bid. It must also provide the required product lists and evidence for cleaning products, hand soap and tissue-paper products: applicable ecolabel certificates or, where products do not carry the relevant label, conformity audits or equivalent evidence. Before services begin, the bidder must train the cleaning staff on environmental impacts and provide evidence of the training. During contract performance, it must monitor and record the specified environmental indicators at least one full working day every four months, unless an eligible certified or registered environmental management system or qualifying ecolabel applies. Joint bidders must appoint an authorised representative and include the relevant power of attorney.
