Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in subsection 95(1) of the Estonian Public Procurement Act applies. Before concluding the contract, the contracting authority will check that the successful bidder is not subject to those grounds and may require supporting evidence where necessary.

Qualification criteria and exclusion grounds

The bidder, or each participant in a joint bid, must be registered in a commercial or similar register under the laws of its country of establishment. If registration is not legally required, the bidder must provide a copy of its founding document or an equivalent document. The bidder must be the official distributor in Estonia of the offered equipment and provide evidence issued by the manufacturer, or a copy of that evidence. The bid must include the prescribed participation declaration with the required information and confirmations. It must remain valid for at least 3 months from the bid submission deadline. If a signatory’s right to represent the bidder is not evident from the register, a power of attorney must be included. Joint bidders must provide an authorisation appointing their representative. The bidder must provide the equipment’s technical description, including the actual numerical values of all required parameters, and identify the pages in the manufacturer’s information material that substantiate compliance. The manufacturer’s information material and user manual must also be included. The equipment must comply with applicable European Union requirements and bear the CE mark; supporting documents must be provided. The manufacturer’s and supplier’s warranty for the equipment must be at least 12 months, and the warranty for spare parts at least 3 months. The exact warranty terms must be submitted. The bid must include a price list for repairs and repair call-outs that remains valid throughout the contract, including compensation for transport to and from the contracting authority’s premises, and a compliant price offer covering all costs of delivering the equipment to Pärnu Hospital. The bidder must confirm that repairs will be carried out at the equipment’s location or at the manufacturer’s premises or those of a partner authorised by the manufacturer. The hospital must receive a free replacement unit while the equipment is away from its premises for repair. The contracting authority may request a sample device. If requested, the bidder must deliver it to Pärnu Hospital at its own expense within 4 weeks of the request. The sample’s temperature will be monitored for 3 days and must remain between +3 °C and +7 °C, except for fluctuations caused by opening the door or moving the sensor. The bid must confirm that a sample can be supplied if required. The bidder must confirm compliance with the procurement documents and, where relevant, explain equivalence and provide supporting evidence. Any claimed trade secret must be identified and justified; the bid price and figures used for evaluation may not be classified as trade secrets.
